Terms & Conditions

  1. General

These Terms and Conditions apply to all quotations, orders, sales, deliveries and services supplied by Reco Handling (“the Company”), unless otherwise agreed in writing.

Any variation to these Terms and Conditions must be agreed in writing and authorised by a Director or an authorised representative of Reco Handling.

Unless otherwise agreed, all sales are made on a business-to-business basis. Consumer cancellation rights under the Consumer Contracts Regulations do not apply to business customers.

  1. Delivery

Whilst Reco Handling will make every reasonable effort to deliver goods within the estimated delivery times, all delivery dates are estimates only and are not guaranteed.

Orders for next working day delivery must be received by 12:00 noon. Orders placed after this time may be delivered within two working days.

Reco Handling shall not be liable for delays caused by circumstances beyond its reasonable control, including but not limited to:

  • Force majeure
  • Industrial disputes
  • Supply chain disruption
  • Transport delays
  • Government restrictions
  • Acts of war or civil unrest

If goods become unavailable due to circumstances beyond our control, Reco Handling reserves the right to cancel the order. Any payments already received will be refunded in full.

Free carriage applies to qualifying orders over £250 (excluding VAT) unless otherwise stated. Where delivery cannot be completed because the recipient is unavailable or refuses delivery, additional delivery, storage or return carriage charges may apply.

  1. Risk and Ownership

Risk in the goods passes to the customer upon delivery or collection, whichever occurs first.

Ownership of the goods remains with Reco Handling until payment has been received in full.

Customers should inspect all deliveries upon receipt and notify both the carrier and Reco Handling immediately of any transit damage.

Goods returned to Reco Handling remain the customer’s responsibility until safely received by us.

  1. Payment Terms

Unless otherwise agreed in writing, all invoices are payable immediately and in full without deduction or discount.

Cheque payments are accepted subject to clearance.

Any bank charges or transaction fees incurred by cheque payments shall be the responsibility of the customer.

Where payment is overdue, Reco Handling reserves the right to:

  • Charge statutory interest and compensation in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
  • Suspend further deliveries.
  • Require immediate payment of all outstanding balances.
  • Recover reasonable costs incurred in collecting overdue amounts.

Customers may not withhold payment or offset any amounts unless agreed in writing or determined by a court of competent jurisdiction.

  1. Warranty

Customers must inspect goods immediately upon receipt.

Any shortages, incorrect items or visible defects must be reported in writing within 7 days of delivery.

Failure to notify Reco Handling within this period may invalidate any claim relating to visible defects.

Unless otherwise stated, new products supplied by Reco Handling carry a 12-month manufacturer’s warranty from the date of delivery.

Used, refurbished or clearance items are sold without warranty unless expressly stated otherwise.

Where a valid warranty claim is accepted, Reco Handling may, at its discretion:

  • Repair the goods;
  • Replace the goods; or
  • Refund the purchase price.

This warranty does not cover damage resulting from misuse, incorrect installation, neglect, unauthorised repairs, accidents or normal wear and tear.

  1. Limitation of Liability

Nothing within these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence;
  • Fraud or fraudulent misrepresentation;
  • Any liability which cannot legally be excluded.

Subject to the above, Reco Handling’s total liability shall not exceed the value of the goods supplied.

Reco Handling shall not be liable for any indirect or consequential losses including, but not limited to:

  • Loss of profits
  • Loss of business
  • Loss of contracts
  • Loss of goodwill
  • Business interruption
  1. Retention of Title

Ownership of all goods remains with Reco Handling until payment has been received in full.

Until ownership passes, the customer shall:

  • Store the goods separately;
  • Keep the goods clearly identifiable;
  • Maintain the goods in satisfactory condition;
  • Not pledge or use them as security.

If payment is overdue, Reco Handling reserves the right to recover the goods without notice.

  1. Data Protection

Reco Handling will collect and process customer information only as necessary to fulfil orders, manage customer accounts and comply with legal obligations.

Personal data will be handled in accordance with applicable UK data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

  1. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

  1. Governing Law

These Terms and Conditions shall be governed by the laws of England and Wales.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

  1. Order Cancellations and Refunds

Orders may only be cancelled or amended before processing.

Once an order has been processed or dispatched, cancellations or amendments cannot be guaranteed.

Orders placed through our website that have been paid for may be cancelled prior to dispatch. Refunds will be made to the original payment method, less any non-refundable payment processing fees where applicable.

Orders refused at delivery or returned without authorisation may be subject to return carriage, handling and restocking charges.

Special order, bespoke or made-to-order products cannot be cancelled once production or procurement has commenced and are non-returnable unless faulty.

  1. Returns

No goods may be returned without prior authorisation from Reco Handling.

Authorised returns must be received in unused, saleable condition and in their original packaging.

Reco Handling reserves the right to charge a restocking fee where appropriate.

Faulty goods will be handled in accordance with the manufacturer’s warranty and applicable consumer legislation where relevant.

Reco Handling reserves the right to amend these Terms and Conditions at any time without prior notice. The version applicable shall be that in force at the date an order is accepted.
